What documents must the officials present?

- In the first place, there shall be no less than two law enforcement officers, who must present their law enforcement certificates. Secondly, the officials must present a legal document ("Search Warrant") issued by the competition authority in charge.
- When the officials present the Search Warrant and their law enforcement certificates, check very carefully:
- Is our company the addressee?
- Which law enforcement authorities are they from?
- What are the names and enforcement ID numbers of the officials?
- What accusations are being raised against our company (subject matter of the inspection)?
- Where may the officials search?
(If possible, make a copy of the Search Warrant and their law enforcement certificates)?
- If there is no Search Warrant or law enforcement certificates or both, object to any inspection. However, do not attempt to stop the officials. Follow the same procedure if the officials extend the scope of the investigation on the spot.

- You are only obligated to passively tolerate the inspection. You are therefore not obligated to actively assist the inspection. However, if you refuse the inspection, the officials may use direct force (e.g. in order to open a cupboard). Therefore cooperation is recommended.
- The inspection can extend to all business premises, cupboards, desks, safes, cars, IT systems or persons. You may not deny the officials access to any such premises and/or objects.
- The officials are also entitled to ask questions (see "Who may be interviewed by the officials and how?").

The officials are entitled to request explanations from all employees. Each interviewee must bear in mind that he/she might be held personally liable under Chinese law.
- Questions about personal details (incl. profession) must be answered.
- Ask if you are questioned as a (potential) suspect or as a witness.
- If you are questioned as a (potential) suspect, request for consulting an external lawyer beforehand with respect to questions on the subject matter. If possible, do not make any statement on the subject matter until the availability of the external lawyer.
- If you are heard as a witness, request for consulting an external lawyer beforehand. All relevant questions must be answered.
- Answer only questions actually relating to the inspection. Answer only the questions asked. Stick to facts and do not comment from a legal point of view. Give short and precise answers. Tell the officials if you do not know the answer to a question. Do not make any assumptions.
