What documents must the officials present?

- In order to search a company the officials must present a written authorization of inspection from the Commission.
- If the officials search in private homes or private cars a search warrant issued by the court is required.
- Read the documents very carefully and check:
- Is our company the addressee?
- What accusations are raised against our company (subject-matter of the inspection)?
- Where may the officials search?

- The officials are entitled to search all rooms and cars as set out in the documents presented. You may not deny the officials access to any such premises. You are only obliged to passively tolerate the inspection. You are therefore not obliged to actively assist the inspection. However, if you refuse the inspection, the officials may use direct force (e.g. in order to open a cupboard). Therefore cooperation is recommended.
- The inspection can extend to all business premises, cupboards, desks, safes, cars, IT systems or persons. You may not deny the officials access to any such premises and/or objects.
- The officials are also entitled to ask questions (see "Who may be interviewed by the officials and how?").

The officials are entitled to request explanations from all employees. Each interviewee must bear in mind that he/she might be held personally liable under Albanian law.
- Ask that you only be questioned in the presence of the external lawyer.
- Request that questions be asked only in a formal interview which ensures that questions and answers are recorded. Request a copy of all records made by the officials. Never sign any document before having consulted a lawyer. Sign the records only if they are correct and complete. If they are not correct or complete, insist that they are corrected or ask the official for additional time to make the corrections.
- Explain to the officials that only the management is entitled to give statements on behalf of the company.
- Questions about personal details (incl. profession) must be answered.
- Ask whether you are being questioned as a (potential) suspect or as a witness.
- If you are questioned as a (potential) suspect, you have the right to remain silent with respect to questions on the subject matter. In that event do not make any statement on the subject matter.
- If you are heard as a witness, ask to be properly summoned and refuse to comment until summoned. If you are summoned as a witness there and then and are questioned on the spot, insist on consulting an external lawyer beforehand. As a witness you are entitled to refuse to answer to all questions which could incriminate you (or a close relative). All other questions must be answered.
- Answer only questions actually relating to the inspection. Answer only the questions asked. Give short and precise answers. Stick to facts and do not comment from a legal point of view. Tell the officials if you do not know the answer to a question. Do not make any assumptions.
